These Terms of Service (“Terms”) govern your access to and use of the Hum mobile application, the Hum website at expient.in/products/hum, and related services (together, “Hum” or the “Service”). Hum is operated by Expient (“we”, “us”, “our”). Please read these Terms carefully before using Hum.
1. Acceptance of Terms
By creating an account, downloading the Hum app, or otherwise using Hum, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least eighteen (18) years of age to use Hum. By creating an account, you represent and warrant that you are at least 18 years old. Hum is not intended for, and may not be used by, anyone under the age of 18. If we discover that a user is under 18, their account will be suspended and all associated data deleted. See our Child Safety Policy for more.
3. Account Registration
You register for Hum by verifying a phone number via one-time password (OTP). You are responsible for keeping your device, phone number, and account credentials secure. You may create only one account per person. Any attempt to operate multiple accounts, share accounts, or register on behalf of another person may result in termination.
4. User Conduct
You agree to use Hum respectfully and lawfully. You must not:
- Harass, bully, threaten, or intimidate any other user.
- Share sexually explicit, violent, hateful, or otherwise illegal content.
- Impersonate another person or misrepresent your affiliation with any person or entity.
- Use Hum for commercial solicitation, spam, promotion, or recruitment.
- Attempt to contact or interact with minors on or through the Service.
- Share any personal identifying information of another user without their express consent.
- Interfere with, disrupt, or attempt to reverse-engineer any part of the Service.
5. Pseudonymous Identity
Hum is designed around pseudonymous interaction. Users participate using only a self-chosen username and avatar. You must not attempt to discover, request, or share another user’s real-world identity, phone number, address, workplace, or other identifying details. Doxxing — the unauthorised public disclosure of another user’s identity — is a bannable offence and may be reported to law enforcement.
6. Content & Conversations
Voice calls on Hum are transmitted using end-to-end encryption and are not recorded, stored, or transcribed by us. You are solely responsible for the content of your own conversations. We reserve the right to suspend or terminate accounts that violate our community guidelines, based on user reports, automated safety signals, or lawful requests from authorities.
7. Reputation & Warmth Score
Hum maintains a reputation system that reflects the quality of your conversations. Abruptly ending conversations or behaviour that diminishes the experience for other users may negatively affect your standing. Reputation indicators are non-transferable and cannot be exchanged for money or goods. Hum reserves the right to modify the scoring system at any time.
8. Availability (Golden Hour)
Core matching and calling features are available during designated evening hours (“Golden Hour”). We reserve the right to modify, expand, or restrict availability windows to maintain service quality or respond to demand.
9. Intellectual Property
The Hum name, logo, wordmark, app design, source code, illustrations, and all content created by us are the intellectual property of Expient and are protected under applicable Indian and international laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use Hum for personal, non-commercial purposes only. You retain no ownership in your pseudonymous profile or avatar.
10. Termination
We may suspend or terminate your account, with or without notice, for any violation of these Terms or any conduct that we, in our sole discretion, deem harmful to the community. You may delete your account at any time through the in-app settings. Upon deletion, your personal data will be permanently removed in accordance with our Privacy Policy.
11. Disclaimers
Hum is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the quality, safety, accuracy, or legality of interactions between users. Hum is not a substitute for emergency services, professional counselling, medical advice, or therapy. If you are in crisis, please contact local emergency services or Childline (India) at 1098.
12. User Responsibility for Conduct & Content
All interactions and communications conducted through Hum are the sole responsibility of the participating users. Hum provides the platform infrastructure only and does not participate in, monitor, endorse, or control the content of voice conversations between users. You are solely responsible for all communications you engage in. Any arrangements or commitments made between users are exclusively between those users — Hum is not a party to them. You agree not to use the platform for sexually explicit, obscene, defamatory, abusive, threatening, or illegal communications. Abusive language, harassment, threats, hate speech, and any form of verbal misconduct directed at other users are strictly prohibited.
13. No Liability for User Interactions
Hum functions as an intermediary platform under the Information Technology Act, 2000. To the maximum extent permitted by applicable law, Hum shall not be held responsible or liable for any interactions, disputes, or incidents between users. Hum does not guarantee the identity, intentions, or conduct of any user. Users engage with other users entirely at their own risk. Hum shall not be liable for any damages arising from user interactions, including emotional distress, harassment, defamation, or any other harm.
14. Assumption of Risk
Voice conversations with strangers carry inherent risks. Hum provides safety tools (reporting, blocking) but does not guarantee their effectiveness in preventing all undesirable interactions. You assume full responsibility for your decision to engage in conversations. In the event of any legal dispute arising from interactions on the platform, the participating users shall bear sole responsibility. Hum, its operators, directors, and employees shall not be made party to such proceedings.
15. Indemnification
You agree to indemnify and hold harmless Expient, its directors, officers, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the platform, your violation of these Terms, your interactions with other users, any content you communicate, or any violation of applicable law by you.
16. Intermediary Status
Hum claims the benefit of the safe harbour provisions under Section 79 of the Information Technology Act, 2000 and complies with applicable due diligence requirements. Hum exercises no editorial control over user-generated voice conversations and acts as a neutral intermediary platform.
17. Limitation of Liability
To the maximum extent permitted by Indian law, our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim, or ₹5,000, whichever is less. In no event shall we be liable for indirect, incidental, consequential, special, or punitive damages.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or via the phone number associated with your account. Your continued use of Hum after any such changes constitutes acceptance of the updated Terms.
